Damages You Can Recover With Your Florida Personal Injury Protection (PIP)

Florida is a no-fault insurance state when it comes to auto accidents. PIP will cover your injury-related expenses, including hospitalizations, medications, and lost wages. It will do so regardless of who is primarily at fault in the rideshare crash.

However, you can only recover economic damages in a PIP claim and only up to about $10,000. For many, this amount of money isn’t sufficient to cover their financial and personal losses after an accident.

Our Daytona Beach rideshare accident attorney can figure out how much you are owed by adding up all of your expenses and losses. If you are eligible to pursue compensation through other insurance options, we will do so on your behalf.

Requirements for Filing Third-party Rideshare Accident Actions

You can file a claim or lawsuit against the rideshare service, the rideshare driver, or the other motorist (depending on who is at fault for the accident) if your injuries are severe enough. It will let you recover both economic and non-economic damages.

Criteria for filing include:

  • Loss of important bodily function
  • Permanent injuries or significant disfigurement
  • A loved one’s passing

Our Daytona Beach rideshare accident lawyer can review your situation to determine whether you meet these criteria. If you are eligible, we can pursue your options for recovery.

Liability Insurance Requirements for Daytona Beach Rideshare Drivers

All rideshare services must offer liability insurance. According to Florida Statutes § 627.748, the rideshare company must provide the following coverage when the driver is logged on to the rideshare app:

The Driver Has No Arranged Rides Yet

If the rideshare driver is online but has not yet arranged a ride, the company must provide at least:

  • $50,000 for injuries or deaths per person
  • $100,000 for injuries or deaths per incident
  • $25,000 for property damages per incident

If the Driver Is Engaged in Rides

Meanwhile, if the driver is en route to pick up a passenger or is already engaged in a ride, the mandatory liability coverage includes $1,000,000 for injuries, deaths, and property damage per accident.

What If the Driver Is Logged Off?

The rideshare driver’s personal auto insurance policy would cover their victim’s damages if the accident happened while they were offline. Rideshare services only consider drivers on duty when they are logged on.

You Must File Your Rideshare Accident Case On-Time

Our Daytona Beach rideshare accident lawyer will also help you comply with your filing requirements. One such requirement is the state statute of limitations for personal injury cases. In Florida, you cannot file a lawsuit more than two years after the date of your rideshare accident.

Filing late may get your case dismissed or barred, so you will want to start working on it while you still have ample time. The attorney can also make sure your case progresses on schedule.
